§ 38-359. Stopping, standing or parking restricted or prohibited on certain streets.

  • (a)

    The provisions of this section restricting the standing or parking of a vehicle shall apply at all times or at those times specified in this section or as indicated on official signs except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic-control device.

    (b)

    The provisions of this section imposing a time limit on parking shall not relieve any person from the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles in specified places or at specified times.

    (c)

    The traffic engineer may impose restrictions or prohibitions on standing, stopping or parking whenever the traffic engineer believes that said restrictions are warranted in his or her professional opinion, and they shall apply as follows:

    (1)

    When signs are erected or curb markings are installed restricting parking on certain streets, no person shall park a vehicle in violation of the restrictions;

    (2)

    When signs are erected giving notice that stopping, standing or parking is prohibited during certain hours on certain streets, no person shall stop, stand or park a vehicle between the hours specified on the sign or otherwise in violation of the restrictions; or

    (3)

    When signs are erected giving notice that parking time is limited on certain streets, no person shall park a vehicle for longer than the time indicated on such signs.

    (d)

    Whenever the provisions of this Code regarding the establishment of parking restrictions are warranted in the professional opinion of the traffic engineer, and as a consequence a parking time limit is imposed or parking is prohibited on designated streets, it is the duty of the traffic engineer to erect appropriate signs or markings giving notice of the restrictions or limitations.

    (e)

    The traffic engineer is granted such authority as is reasonably necessary to establish boundaries for the residential street or portion of street within a neighborhood area based upon traffic flow, usage, and the character of land uses within the area.

    (f)

    No regulation authorized in this section shall be effective unless signs or markings giving notice of prohibitions or limitations are erected and in place at the time of any alleged offense.
