§ 32-14. Collection, transfer, transport and disposal.

  • (a)

    Sufficient, trained employees and equipment to ensure the sanitary and expeditious collection, transfer, transportation and disposal of all solid waste originating within the county shall be provided by the county.

    (b)

    At least one refuse disposal site shall be maintained by the county. This disposal site must be registered or permitted in accordance with SWMR. If recycling and composting are initiated in the county, then applicable permits will be obtained from the state environment department in accordance with SWMR.

    (c)

    Solid waste collection and recycling routes shall be designated by the county manager in a manner consistent with health requirements, effectiveness, efficiency and economy.

    (d)

    All solid waste and recyclables shall be collected and dispositioned by the county with the exception of:

    (1)

    The United States or any of its agencies and its designated agents are authorized to establish collection and disposal of solid waste accumulated on United States property, meeting applicable regulations;

    (2)

    Non-putrescible solid waste may be collected and transported by those businesses engaged in construction, remodeling or demolition from the premises involved within the confines of the county. These businesses shall be registered and licensed as required by law to perform business in the county and shall transport the resultant solid waste to the county solid waste facility and pay applicable fees specified in section 32-18.

    (3)

    Tree and yard trimmings accumulated by persons regularly engaged in the business of gardening or landscaping may be collected and transported from the premises within the county, provided that those regularly engaged in the business of gardening or landscaping are in compliance with county requirements for operating the business within the county and shall pay applicable fees specified in section 32-18.

    (4)

    Business and commercial establishments may transport non-putrescible solid waste to the solid waste facility and shall pay applicable fees as specified in section 32-18.

    (5)

    Occupants or owners of private residences may transport occasional loads of solid waste and pay applicable fees as specified in section 32-18.

    (e)

    All dumping of waste products in the county solid waste facility shall be done under the supervision of county employees or in accordance with policies, procedures and signage at the facility.

    (f)

    Any person violating this section shall be subject to the penalties provided in section 1-8 of this Code.
