§ 28-31. False alarms.

  • (a)

    It is unlawful to:

    (1)

    Make, give or turn in any false alarm of fire, injury, death or other emergency, knowing it to be false;

    (2)

    Knowingly aid or assist in creating a false alarm of fire, injury, death or other emergency;

    (3)

    Interfere with the proper functioning of an alarm system.

    (b)

    Any person who commits any of the unlawful acts in subsection (a) which causes death or great bodily harm to another shall be guilty of a fourth degree felony under NMSA 1978, § 30-7-21, but if such death or great bodily harm is not caused, the person is guilty of a misdemeanor.
