§ 26-3. Probation.

  • (a)

    It is unlawful to violate the terms and conditions for probation, bond or bail set by the municipal judge. Such a violation is punishable as contempt of court.

    (b)

    It is unlawful to knowingly aid or assist another person known by him to be subject to the terms or conditions of probation, bond or bail to violate a term or condition of his probation, bond or bail. Such a violation is punishable as a petty misdemeanor.

    (c)

    Any person placed on probation by the municipal judge as part of a sentence for violating any provision of this Code shall pay, in addition to any fee or penalty assessment, a fee of $60.00 for each month, or portion thereof, of probation to defray the costs of supervision by the municipal court probation officer.

    (d)

    The municipal judge shall assess a fee of $15.00 for each day for each electronic monitoring device mandated as part of a person's probation.

    (e)

    The municipal judge may mandate that as part of the terms and conditions of probation the person shall be responsible for vendor costs associated with the installation and use of alternative monitoring devices.

    (f)

    Removing, attempting to remove or otherwise tampering with a monitoring device shall constitute a violation of the terms and conditions of probation. The person mandated to use the monitoring device shall be responsible for any damage resulting from removing, attempting to remove, or otherwise tampering with the monitoring device.

    (g)

    In cases of indigency or where appropriate in the municipal judge's discretion, the municipal judge may waive all or part of the fees or costs assessed or mandated in accordance with this section.

    (h)

    All fees assessed in accordance with this section shall be paid to the municipal court monthly unless otherwise ordered by the municipal judge and shall be deposited in the general fund of the county.
