§ 20-2. Late payment fees on past due accounts for materials and services accounts.

  • (a)

    A late payment fee of 1½ percent per month shall be assessed to every past due account for materials or services provided by the county, including those provided by the utilities department. An account is considered due at the time of billing and is considered past due 30 days after the billing date. The late payment fee shall be added to any principal balance due on the account and assessments of late payment fees shall be made no more than one time per month and shall not be prorated for any partial months. Any revenue received in the form of late payment fees shall be accounted for in the same fund as the principal amount.

    (b)

    Accounts for materials or services shall include a contractual provision that the other party shall pay the attorney's fees and expenses of the county if the county prevails in any collection action on the past due account.
