§ 16-159. Special plan (SP) district review criteria.

  • During the course of the review of any request for a special plan (SP) district, the IDRC shall utilize the following criteria in formulating a recommendation to the planning and zoning commission. The planning and zoning commission shall utilize the following criteria in making its recommendation of approval, conditional approval or denial to the county council, and the county council shall utilize the following criteria in making a determination of approval or denial:

    (1)

    The request shall diversify available housing or commercial options with a variety of price ranges, product types and designs that will appeal to various niche markets for diversifying and revitalizing the local economy;

    (2)

    The request will enhance environmental quality and sustainability through innovative site planning and design standards that provide greater flexibility for siting buildings while preserving environmentally sensitive areas;

    (3)

    The request will ensure compatibility of land uses and architecture and mitigation of development impacts within the property and on adjacent property through effective planning and architectural design standards;

    (4)

    The request substantially conforms to the comprehensive plan and shall not be materially detrimental to the health, safety and general welfare of the county.
