§ 12-33. Business registration or license required.

  • (a)

    Any person, group, organization, business or entity proposing to engage or engaging in business within the county after January 1, 1982, and that is required by the state to pay gross receipts taxes on its business in the county shall be required to apply for a business registration or business license and pay the applicable fee, as prescribed in sections 12-34 or 12-35.

    (b)

    Any person filing an application for issuance or renewal of any business registration or business license shall include in the application his current taxation and revenue department taxpayer identification number or evidence of application for a current taxation and revenue department taxpayer identification number.

    (c)

    In case a license or permit is required by any commission or licensing agency of the state before a person may lawfully engage in such business in the state, it shall also be required that such person shall have obtained such license or permit and exhibited proper evidence thereof to the county prior to issuance of registration or license under this chapter.

    (d)

    The payment of the business registration fee or the business license fee, and the issuance of a registration or license by the county shall not entitle the holder thereof to carry on any business unless he has complied with all requirements of this code and all other applicable laws, nor to carry on any business in any building or any premises designated in such registration or license in the event that such building or premises are situated in a zoning district or locality in which the conduct of such business is in violation of any law.

    (e)

    Every person having a license or registration shall keep such license or registration posted or exhibited in a conspicuous part of the place of business accessible to the public, except that in the case of any machine that dispenses goods, services or entertainment, the name, address and telephone number of the owner and the person responsible for the operation of the machine, if different, shall be located on the machine in a place easily visible to the public. Any person holding a license or registration shall produce and exhibit the same, whenever requested to do so by any person.

    (f)

    Any business license or business registration issued shall not be transferable to any other person or entity or to any other location.

    (g)

    For the purposes of enforcing the provisions of this chapter the authorized agents of the county are empowered, and the registrant or licensee or applicant for a license or registration shall be deemed to have given permission, to enter upon the place of business of any person or entity that has applied for or obtained a business registration or business license during business hours to make the inspections and investigations required under this code. The authorized agents of the county shall perform inspections and tests in a manner that will not unduly interfere with the performance of the business. This authority to enter shall not include the interiors of private parties' dwellings or living quarters, or the portions of commercial premises used as dwellings, or the non-public portions of commercial premises, except upon obtaining a search warrant, or permission of the occupant thereof, or permission of the parties responsible therefor in the event the premises are unoccupied. The provisions of this section do not apply in the event of explosion, fire or like emergency. In the event that an inspection or investigation reveals that false or misleading information has been filed by the present or prospective licensee or registrant, or the licensee or registrant or applicant therefor unreasonably refuses permission for inspection, the license or registration may be refused or revoked. The authorized agents of the county include the manager, the police chief, the fire chief, the building official, community development director and their designees.
