§ 12-31. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Business means any commercial enterprise, trade, occupation, calling, profession, vocation or activity engaged in, conducted or carried on by any person, his agent or employee, or by the use of automatic machines, except newsracks, for the purpose of gain, benefit or advantage, either direct or indirect, on which state gross receipts tax is paid or payable. A charitable organization shall be deemed to be a business if it is required to pay gross receipt taxes on a business conducted in the county.

    Food means any solid or liquid substance intended for human consumption.

    Food service establishment means:

    (1)

    Any fixed or mobile place, temporary or permanent, where food is served and sold for consumption on or off the premises;

    (2)

    Any fixed or mobile place, temporary or permanent, where food is prepared for sale to or consumption by the general public either on or off the premises, but the term "prepared," as used in this subsection, does not include food processing in which food is processed for ultimate sale in a sealed original package, nor does it include the preparation of raw fruits and vegetables for display and sale in a grocery store or similar operation; and the term "general public," as used in this subsection, includes, but is not limited to, residents and employees of institutions that provide meals or food to their residents or employees, either with or without direct payment to the institution by the residents or employees; and

    (3)

    Meat markets, whether or not operated in conjunction with a grocery store.

    Home occupation means a business, profession or service operated on a residential lot.

    Per annum means for each calendar year.

    Place of business means each individual business location where the business is maintained or conducted. A separate business license or registration shall be obtained for each branch establishment or location of the business transacted and for each separate type of business under the same ownership at the same location if each such business requires a license and not a registration; provided, however, that the owner of any machines that dispense goods, services or entertainment at the request of the vendee shall only be required to obtain a single business license or registration which shall suffice for such machines wherever located within the county; and provided further that any machine located on the premises owned by the owner of the machine shall not require a separate license.

    Solicitation means selling, offering for sale, delivering, bartering, exchanging, peddling or hawking any goods, wares, merchandise, property (either real or personal), tangible or intangible, or services, or the making of personal appointments, attempting to procure or the procuring of interviews, or arranging for demonstrations or explanations preliminary to selling, offering for sale, selling and delivering, bartering, exchanging, peddling or hawking of any of the same.
